Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Stoke platform available at trystoke.io (the "Service"), operated by Stoke ("we", "us", or "our"). By creating an account or accessing the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years of age to use the Service. By using Stoke, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@trystoke.io if you believe your account has been accessed without authorization. We are not liable for any loss or damage arising from unauthorized use of your account.
4. Subscriptions and Credits
Stoke uses a credit-based system. Credits are allocated to your account each month according to your subscription plan. Credits may be used to generate content drafts, use the AI Copilot, and perform other actions within the Service.
- Unused credits do not carry over to the next billing period.
- Cancellation takes effect at the end of your current billing period. You retain access to the Service and your remaining credits until that date.
- We may change subscription pricing or the number of credits included in a plan at any time. We will notify you of such changes by email or through a prominent notice within the Service before they take effect.
- The credit cost of individual actions within the Service (such as content generation, transcript processing, or AI Copilot usage) may be adjusted at any time without prior notice to reflect changes in underlying service costs or operational requirements. Current credit costs for all actions are available within the Service.
- We may add, modify, or remove features available on any subscription plan at our sole discretion. Where a material feature is removed from a paid plan, we will provide advance notice and, where applicable, a prorated credit or refund for the affected billing period.
5. Refund Policy
If you are not satisfied with Stoke, you may request a full refund within 7 days of the initial charge for a subscription period. No refunds will be issued after this 7-day window has passed.
To request a refund, email support@trystoke.io with the email address associated with your account. Refunds are processed to the original payment method and may take several business days to appear.
6. Content Ownership
You retain full ownership of all content you submit to the Service, including URLs, transcripts, notes, and custom instructions. You also own the AI-generated drafts produced from your inputs.
By using Stoke, you grant us a limited, non-exclusive, royalty-free license to process, store, and transmit your content solely for the purpose of providing the Service to you. We do not claim ownership of your content and do not use it for any purpose beyond delivering the Service.
7. Acceptable Use
You agree not to use the Service to:
- Submit or generate content that is illegal, defamatory, harassing, or infringes the intellectual property rights of others.
- Circumvent or manipulate the credit system or any access controls.
- Generate spam, coordinated inauthentic content, or deliberate misinformation.
- Scrape, reverse-engineer, or copy any part of the Service or its underlying technology.
- Share account credentials or resell access to the Service.
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
8. Third-Party Services
The Service integrates with third-party providers for authentication, payment processing, content extraction, and AI generation. These providers operate under their own terms of service and privacy policies, which are separate from these Terms. We are not responsible for any outages, errors, or data handling practices of third-party services.
9. Intellectual Property
The Stoke platform, including its branding, user interface, design, and underlying software, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose. You are responsible for reviewing AI-generated drafts before publishing or distributing them.
11. Limitation of Liability
To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these Terms or your use of the Service will not exceed the amounts you paid to us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless Stoke and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your content, or your violation of these Terms.
13. Termination
You may cancel your account at any time through your account settings. We may suspend or terminate your access to the Service at any time if we determine that you have violated these Terms or for any other reason at our sole discretion.
Upon termination, provisions of these Terms that by their nature should survive (including Sections 6, 9, 10, 11, 12, and 14) will remain in effect.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide notice by email or through a prominent notice within the Service at least 7 days before the updated Terms take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
